PLEASE READ THESE TERMS AND CONDITIONS
CAREFULLY AS YOU ARE ENTERING INTO A CONTRACT WITH US AND AGREEING TO THE FOLLOWING TERMS AND CONDITIONS BY USING THE SERVICES OF FARGO’S ART
You, the client, the customer, or "you're," refers to the individual who requested our services and enters into this contract. "We," "us," and "our" refer to Fargo's Art.
Section 1: Quotes and Fixed Rates
1.1 Agreement
A documented agreement for the precise work to be done at the price quoted is represented by the agreed-upon final quote.
Except as expressly provided in the contract, it does not protect verbal agreements.
The customer and Fargo's Art come to a deal. The individual who sought the quotation is referred to as the "client."
Except when the client has given written consent to do so, Fargo's Art will not converse with, accept requests from, or otherwise communicate with anybody other than the client.
By accepting the quote, whether electronically or by another method, you are fully agreeing to these terms and conditions.
Please double-check your quote.
1.2 The extent of the work cited
The quote that Fargo's Art created for the customer reflects the client's requests. This is not a builder's survey, and we won't be held responsible for any work that isn't specified in the written estimate.
1.3 Water and electricity
Where it is practical, the client will be required to supply running water, electricity, and restrooms.
1.4 The state of the existing ceiling and walls
Without being particularly stated, it is presumed that the plastering beneath papered walls and, ceiling surfaces is in good condition and is suitable for the treatment being described, thus, no provisions are made for its restoration. Similarly, unless an allowance is made for such items, the costs of repairs and renewals for any problems that are not obvious at the time of estimating will be charged.
1.5 Termination
The client undertakes to give Fargo's Art written or email notice of cancellation 28 days before the project's start date.
If Fargo's Art is not notified of the cancellation, the client agrees to pay all Fargo's Art administration, lost work, and scheduling costs, up to 15% of the total project cost.
If the customer chooses to cancel our services after we have begun work, the customer agrees to pay Fargo's Art administration, lost work, and scheduling costs in the amount of at least 50% of the total project cost. Postponement rather than cancellation of scheduled work is acceptable only if the rescheduled date is genuine and within 8 weeks of the originally scheduled date. If you postpone our services further, you will be considered to have canceled them, and the cancellation levy will apply as described above.
1.6 Resources
Unless otherwise agreed, we will provide all necessary materials, which will always be of high quality and used following the manufacturer's guidelines. Where it is necessary to match existing decor, we will do so, using appropriate materials that provide an exact match where possible. If an exact match is not possible, the client will be contacted. Fargo's Art accepts no responsibility for the performance or suitability of any materials, parts, or products purchased directly by the client and authorizes Fargo's Art to use them at their own risk.
1.7 Modifications to your quote
If a customer makes changes to their property or building after receiving a quote from Fargo's Art, they must notify us as soon as possible so that their quote can be revised. Any changes made without notifying us may cause a delay in the work until a price for any changes has been agreed upon.
1.8 Timelines for completion
Estimated completion times are guidelines, and while we will make every effort to complete the work within the time frame specified, we will not be held liable if the scheduled work is not completed within the time frame specified. Similarly, by utilizing additional resources, we may be able to complete a project sooner than anticipated. In that case, the quote's price will remain unchanged.
1.9 Equipment storage
On occasion, we may request that tools be left on-site overnight. The client has the option to decline such requests.
1.10 Quotes' validity period
Quotes are valid for 28 days after they are issued.
1.11 Defects and poor workmanship
It is the client's responsibility to:
Remove valuable and/or fragile items from the decorating areas.
To take down pictures and other items that are hung on the wall.
Remove electrical items from areas where work will be done.
Assistance with the repositioning and/or removal of bulky furniture and goods is available. We reserve the right to refuse to move goods if the condition puts the equipment or property at risk of damage. We reserve the right to refuse to move particularly heavy or bulky items if they pose a greater than acceptable health and safety risk. We will request that items that cannot be covered or protected but could easily be removed be removed before work begins. We are not liable for any damage to such items if they are not removed.
If there is any doubt about the suitability or structural soundness of any working platform, such as a balcony or flat roof, the client may be asked to provide professional evidence, such as a structural engineer's report, before work begins. Where a roof of any type or style is to be used to gain access for external decoration works, Fargo's Art accepts no liability for any damage caused as a result of access during the works.
Fargo's Art will immediately notify the client of any breakage or damage to the property and will take steps to remedy the situation.
Similarly, if the client is dissatisfied with any aspect of the service at the end of the job, they must notify us as soon as possible. Clients must allow Fargo's Art to effect a remedy using our tradespeople, and we will not be held liable for the costs of third-party reparations that we have not expressly agreed to in writing. Fargo's Art must be notified in writing within 24 hours of any alleged breakage or damage caused by our employees.
1.12 Extra effort
We are usually happy to do small "favors" for our clients in addition to our quotations, but this is done at your own risk, and we will not accept responsibility for any work performed that is not included in your written quote, including loss or damage to persons or property.
1.13 Safety precautions
We will take every precaution possible to ensure that all vulnerable areas and any objects left in the work area are carefully covered and/or masked. However, there is always the possibility of overspilling or dust getting past these safeguards. In the unlikely event of spills, dust, or other cosmetic damage, we will make every effort to clean it properly.
1.14 Previous damage
Before the start of the project, we may take photographs of your property or fill out a pre-existing damage form. In the unlikely event that we damage your property as a result of our negligence, you will be fully covered by our insurance. However, claims that we can refute with photo evidence or written agreement will incur a $50 administration fee per complaint.
1.15 Compensation for quoted and fixed-price work
The client agrees to pay the invoice for completed work within 28 days of the project's completion. If the client is dissatisfied with the standard of workmanship, the correct complaint procedure outlined in these terms and conditions must be followed. All materials purchased for or on behalf of the client are the property of Fargo's Art until the client pays the final invoice to Fargo's Art. In the event of a dispute, the client agrees to allow a representative of Fargo's Art access to the property to retrieve all materials that remain on the company's property. We gladly provide invoices to both businesses and individuals. However, payment is due within the timeframes specified in the Terms and Conditions, and the amount is fixed in the quotation unless amended by Fargo's Art. As a result, regardless of whether an invoice has been received, the client is obligated to pay. To cover administrative costs, the second copy of an invoice can be issued for $15 per invoice.
1.16 Finishing the project
If Fargo's Art deems it necessary, the client must be available on the project's final day for consultation and final sign-off. If the client is unable to be reached, unless otherwise agreed in writing, the client accepts that the project has been completed to their satisfaction and full payment is due.
1.17 Contract termination by Fargo's Art
Fargo's Art will not tolerate aggressive or rude behavior, racism, nationalism, sexism, homophobia, or ageism directed at any of its employees or contractors, and reserves the right to terminate the project at any time if this occurs.
PAYMENT SECTION 2
2.1 Payment Options
We accept checks and bank transfers to settle your account.
2.2 Compensation for tradespeople
To pay for your deposit or completed job, you must pay Fargo's Art directly unless you have received permission from one of our directors in the office via email or our contact number; otherwise, your account will remain unpaid until Fargo's Art receives payment directly.
2.3 Payment schedules
The client agrees to pay the invoice when Fargo’s Art finished the project and of the project invoice. Fargo's Art reserves the right to re-issue the invoice and request payment within five days. If the outstanding balance is not settled within 5 days, Fargo's Art reserves the right to charge an administration fee of $80.00 for each subsequent re-issue of invoices.
2.4 Accounts unpaid
If Fargo's Art is unable to recover any outstanding amounts after a reasonable period, we will hire a debt collection agency. The client acknowledges that the debt collection agency will increase the outstanding amount to cover their costs - this fee is applied as soon as the debt is passed from us to them and typically amounts to 33% of the cost of the invoice It is therefore strongly in your interest to settle your invoice as soon as possible to avoid these extra costs. We have no further involvement in the account once the debt is transferred from us to the debt collection agency, and we cannot reverse the process or any associated fees.
SECTION 3 - POLICY ON PRIVACY
Unless required by law, we will never sell or otherwise disclose your contact information to any other company or third party. When you contact us, your information may be saved to help us with your inquiry. Fargo's Art will use your information for correspondence and possibly marketing purposes. Please contact us if you do not want your information used for marketing purposes.
Fargo's Art collects information about you based on your use of our service and visits to our website and other sites accessible through it.
We may collect additional information as a result of your participation in any of our promotions or competitions, as well as information you provide when providing feedback to us. We also track customer traffic patterns and site usage to improve the service we offer.
SECTION 4.- DISCOUNTS AND PROMOTIONS
Fargo's Art runs promotions and offers from time to time; these promotions and offers are subject to the following conditions:
Only labor costs are discounted on hourly rate jobs, half-daily rate jobs, and daily rate jobs.
